Montu Canada Terms and Conditions – complete bicycles and bicycle frames
Thank you for shopping with us! We really appreciate your business and your interest in our products. We want to make sure you have a good experience purchasing from Montu Canada. As with any shopping experience, there are certain terms and conditions that apply. By placing an order and purchasing product from us via our website, phone or email, you agree to the terms below along with other terms on our website, such as return and warranty policies. Please make sure to review everything fully and carefully so you are informed about your rights and obligations.
This is an Agreement between you and all persons you represent (and for purposes of this Agreement referred to as “the Customer,” “your,” or “user” herein) and Montu Canada (“Montu” and sometimes also referred to as “us,” “we” or “our” herein) regarding provision of our products and services and your access to and use of our website and all content, information, products and services offered by Montu Canada.
Description of Service: Montu Canada offers high-quality bicycle frames as well built-to-order complete bicycles. The Customer is fully responsible for reviewing the bike geometry charts provided and ensuring that they select the correct frame size prior to purchase.
Montu Canada can offer general advice on sizing if requested, but this does not supersede a professional bike fit which is the responsibility of the Customer to obtain at their own expense.
Returns: Orders can only be modified or canceled up until its status becomes “Shipped”. After this point, you must initiate a return if you wish to exchange or cancel your order.
We accept returns of unused bikes or bike frames within a 30-day period from delivery.
Be sure you are happy with the bike/frame as once used, returns cannot be accepted. We recommend you keep hold of the packaging just in case you need to return the bike/frame to us.
If you would like to return your bike/frame within the 30-day period, you will need to cover the cost of returning the bike/frame, along with ensuring the bike is securely packaged for transit as originally received.
It is your responsibility to ensure the delivery address entered is accurate, and to use the tracking number provided to claim your shipment.
Payment: Payment on our website or using online invoices is entirely secure. Your banking information is always encrypted, which makes it completely unreadable. Furthermore, the information is directly transferred from your bank to our bank, never through the website or other unsecure online communication channels. This means Montu Canada never has access to your banking information.
We are vigilant regarding online fraud. Therefore, we might investigate and cancel an order if we have good reason to believe it is fraudulent.
Force Majeure: Montu Canada shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, fire, insurrection, strikes, lock-downs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature. We are not responsible for lost, incomplete, illegible, misdirected or stolen messages or mail, unavailable connections, failed, incomplete, or delayed transmissions, online failures, hardware, software, or other technical malfunctions or disturbances, whether or not these circumstances affect, disrupt, or corrupt communications.
Limitation of Liability: The Customer acknowledges and agrees that Montu Canada will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Customer has been advised or otherwise might have anticipated the possibility of such loss or damage.
Montu Warranty & Crash Replacement Policy
Carbon Frames and Wheels
We build our frames and wheels to be ridden hard and kept for a long time. If something goes wrong because of how we made it, we’ll make it right. If something goes wrong because of a curb, a car roof rack, or the laws of physics, we’ll still help, just under different terms. Here’s how it all works.
Section A: Warranty Terms
A1. Two-year, non-transferable warranty. Unless otherwise specified, Montu frames and Montu carbon wheels are warranted against manufacturing defects for a period of two (2) years from the original date of purchase, to the original owner only. This warranty does not transfer with the sale of the bike, so if you bought your Montu second-hand, this section unfortunately isn’t for you (but Section D might be).
A2. Ex-demo frames and wheels (one-year warranty). Montu ex-demo frames and Montu carbon wheels sold as ex-demo units, unless otherwise specified, are warranted against manufacturing defects for a period of one (1) year from the date of purchase, to the original purchaser of the ex-demo unit only. Ex-demo bikes have lived a little before finding you; that’s why they cost less, and this warranty reflects that. All other terms and exclusions in this policy apply equally to ex-demo purchases.
A3. Component warranty (eight months). Components supplied on your complete Montu bike carry an eight (8) month non-transferable warranty against manufacturing defects, for the original owner. This entitles you to the repair or replacement of the faulty item. While we will do our best, Montu cannot guarantee that the original colour, graphic, or specification options will still be available, and we reserve the right to supply an alternative component of appropriate specification where they are not.
A4. Scope of remedy. This warranty is limited to the repair or replacement of the defective frame or wheel, at Montu’s discretion. The owner is responsible for all shipping and postage costs, labour, and the cost of any additional components required to complete the repair or replacement.
A5. Proof of purchase. A valid proof of purchase is required before any warranty claim is accepted for processing. Keep your receipt; a photo of it in your phone counts.
A6. What’s not covered. This warranty does not cover:
- Normal wear and tear, including bearings, spokes, nipples, and decals
- Improper assembly, including frames purchased as a frame-only option and assembled by the owner or a third party
- Corrosion
- Improper or inadequate maintenance
- Accidental damage (crashes, drops, transport damage, garage door encounters)
- Installation of components, parts, or accessories not originally intended for, or incompatible with, the bicycle as sold (please check with us on compatibility before you bolt it on)
- Damage or failure resulting from accident, misuse, abuse, or neglect
- Labour charges for part replacement or changeover
- Any product where the frame has been modified, or where components outside Montu’s recommended specification have been fitted; either voids this warranty in full
Third-party components may also carry their own manufacturers’ warranties, some of which run longer than our coverage in A3. We’re happy to help you navigate those claims.
A7. Your legal rights. This warranty is in addition to, and does not limit, any rights or remedies you may have under applicable consumer protection legislation, including the Ontario Consumer Protection Act and equivalent laws in your province or territory.
Section B: How to Make a Warranty Claim
B1. Email us a description of the issue along with clear photos and/or video. The more detail, the faster we can help.
B2. We may require the frame or wheel to be returned to Montu for inspection so we can determine whether the claim is valid. Montu’s inspection and assessment is the final determination of warranty eligibility.
B3. Expenses incurred during the warranty process (shipping, component removal and reinstallation, and the like) are the responsibility of the owner and will not be reimbursed by Montu.
B4. Warranty inspection may require removal of paint from the damaged area to examine the bare carbon underneath. This paint removal is a necessary part of the inspection and is not covered under warranty. If the claim is found invalid and the frame is returned to you, touch-up of the inspected area is at the owner’s discretion and expense.
B5. Warranty claims made from outside Canada are welcome, but may be subject to additional fees and restrictions (customs, duties, and cross-border shipping being what they are).
Section C: Valid Warranty Claims
C1. If your claim is approved, Montu will replace the frame or wheel with one of the same model and size.
C2. Paint and colourways cannot be guaranteed to match the original purchase; small-batch means paint schemes come and go. If you’d like a replacement painted identically to your original frame (or in something entirely new), you may instead purchase a new frameset from available stock or as a custom order under our Crash Replacement Policy (see Section D).
C3. Replacement timelines. Replacement timelines are not guaranteed, for warranty and crash replacement alike. If your replacement frame or wheel is in stock, we’ll get it moving quickly. If it’s out of stock or ordered as a custom option, allow up to two (2) months for production and delivery. Small-batch manufacturing is worth the wait, but we know that’s cold comfort mid-season, so we’ll keep you updated throughout, and we’d rather quote you an honest timeline than a flattering one.
Section D: Damage Not Covered by Warranty (Crash Replacement)
Not every broken frame or wheel is a warranty claim, and that’s okay; carbon lives an eventful life. If your damage falls outside the warranty (see Section A: expired warranty period, accidental damage, misuse, use outside the product’s intended purpose, and so on), you have two good options:
D1. Crash replacement. Montu will sell you a replacement frame, wheel, or wheelset at 30% off the full retail price. The discount is always calculated on the current full retail price of the replacement, regardless of what you originally paid. This applies equally to products first purchased at full price, on sale, or as ex-demo units. Crash replacement is available to the original owner, once per frame and once per wheelset, and applies to a product of the same or comparable model from available stock or custom order.
D2. Carbon repair. Yes, carbon can often be repaired, depending on the location and extent of the damage. Montu does not currently offer carbon repair in-house, but we’re glad to recommend reputable repair facilities.
Section E: Rebuild Costs for Warranty and Crash Replacement Frames
E1. Warranty replacement frames are supplied as bare (unbuilt) framesets. The cost of transferring components from your original frame to the replacement is not included.
E2. Montu can rebuild your replacement frame for a flat labour rate of CAD $475+tax, plus $90–$120 in consumable parts (new cabling, brake hoses, bar tape, and similar items that shouldn’t be reused). We’ll confirm the parts cost with you before starting work.
E3. If you purchase a crash replacement frame under Section D, Montu offers a 20% discount on the rebuild labour cost.
Section F: Limitation of Liability
To the maximum extent permitted by law, Montu is not liable for indirect, incidental, or consequential damages arising from a frame or wheel defect, including missed race entries, event travel costs, or replacement rental equipment. Our responsibility begins and ends with the frame or wheel itself, as described above.
